Make good choices. When you drink and drive. Don't. But if you do, then follow these simple rules: Provide the cop your license, registration and proof of insurance. Do not answer any questions or make any statements. Do not do any field sobriety tests or a portable breath test, but you need to blow at the station in a BAC machine. Immediately ask to speak to attorney Aaron Lukoff at 360-647-5251. There are cops out looking to arrest you for DUI. Police are looking more steadily and diligently for impaired drivers than usual. And, it's not against the law for them to do so. Certainly here in Washington, police step-up their efforts significantly for drunk drivers during the holidays --- with a determination that borders on fanatic zeal and yes, the police were in fact looking for you to drink and drive (though not by name or personal knowledge) --- and, yes, we will do our job and make sure that your 4th, 5th and 6th Amendment rights are protected during this traumatic judicial process. What's rule number one? Don't talk to cops! If you are stopped for any reason and the officer asks about drinking or marijuana, just say that you want to speak to your attorney and refuse to answer any questions. Give the officer your license, insurance and registration. Don't do any field sobriety tests or a portable breath test. Be polite but don't do them. At the station please do the Draeger BAC test. Do not consent to a blood draw. Again don't answer any questions that they ask you. If you have an untimely run in with law enforcement, then you need to remember to give us a call.
